The federal choose will later rule on Trump’s particular grasp’s software after the listening to concludes

Former President Donald Trump’s push for a special master to oversee the Justice Department’s review of evidence collected at Mar-a-Lago comes at a critical moment, with a hearing on the request due to begin soon on Thursday.

A federal judge has signaled a “tentative intention” to grant the request, which could pose new complications for the DOJ’s closely watched examination of White House documents Trump has brought to his Florida residence.

The following is a Special Master and what would it mean for the materials confiscated in Mar-a-Lago:

What is a special master? A special master is a third-party attorney appointed by a court to oversee part of a specific case.

If appointed in Trump’s case, the special master would oversee the Justice Department’s review of evidence collected at his beach club, filtering out potentially privileged material confiscated during the search.

Why does Trump want a special master? Trump’s legal team generally argues that a special foreman is needed to ensure the Justice Department returns all of his private documents seized during the Mar-a-Lago search.

The former president’s lawyers say his constitutional rights have been violated and privileged material may have been confiscated. But in court filings, Trump didn’t elaborate on what he hoped a particular master would filter out, aside from general references to “privileged and potentially privileged materials.”

What is the attitude of the Department of Justice? The department has already signaled that it is deploying an internal filter team to review the items seized and segregate material that could be the subject of privilege claims.

The DOJ said in a court filing Monday it has identified “a limited amount of material” from its search for documents from Mar-a-Lago that may contain material covered by attorney-client privilege and is in the process of addressing privilege disputes.

Legal officials also confirmed that US intelligence officials are reviewing the documents for classified material.

Investigators have already mentioned the work of a filter team when they returned Trump private documents that would not be part of the investigation, such as two expired passports and his diplomatic passport.

The Justice Department has said in court documents it believes evidence gathered at Mar-a-Lago will aid its criminal investigation into misuse of federal files, including national defense material, after Trump’s team brought boxes of files to Florida when he leave office.

The investigation also addresses a possible obstruction of the judiciary in the investigation.
